Step 2

Please complete and submit the client questionnaire below and upload a copy of the contractor’s written contract.

Step 3

The information will then be reviewed by a consultant who will contact you as soon as possible if there are any queries or if any further information is required. We will also speak to the worker if authorised and necessary.

Step 4

On completion, you and the worker will be provided with a formal written Status Determination Statement.

Please answer all questions as fully and as accurately as possible.  Please note that any answer that is subsequently found to be incorrect may affect the opinion given on the IR35 status.

IR35 Determination – Client information

  • Please attach any relevant job specifications or advertisements at the end of this form
  • For example, move them to a different project or alter any agreed deliverables
  • This pertains to the technical manner in which the work is done (rather than the outcomes) and does not include the requirement to comply with recognised industry standards, regulatory or statutory frameworks
  • E.g. health & safety, data protection, any HR policies or procedures etc
  • E.g. laptop, software, tools etc
  • By answering “yes”, you confirm that you would not reject a substitute with the required skills, qualifications and experience to perform the services and that the worker’s intermediary would be responsible for engaging and paying the substitute
  • E.g. performance bonuses, paid-for training, holiday/sick pay, overtime, memberships etc.

  • This should include the worker’s written contract (or your contract with the agency if not direct) and any previously carried out status determinations or CESTs if applicable.
